Terms of Service

These Terms explain the rules for using CalBudget. CalBudget is a planning tool, not a bank, broker, accountant, lender, financial adviser, tax adviser, or law firm. Please read these Terms carefully before creating an account, starting a trial, subscribing, importing data, or using AI recommendations.

1. Acceptance of These Terms

By accessing or using CalBudget, creating an account, starting a trial, purchasing a subscription, importing data, or using any CalBudget feature, you agree to these Terms and the Privacy Policy. If you do not agree, do not use CalBudget.

If you use CalBudget on behalf of another person, household, company, or organization, you represent that you have authority to use the service and provide data on their behalf.

2. What CalBudget Does

CalBudget provides calendar-first budgeting, balance forecasting, account and category organization, recurring transaction planning, CSV-style import, reports, debt planning tools, optional AI recommendation reports, support tools, and related subscription services.

CalBudget is built around manual planning. It does not require bank-login credentials, does not require direct bank linking, and does not guarantee that your real-world bank balance, card balance, bills, deposits, subscriptions, or debts match what you enter or import. Your forecast is only as accurate as the information you provide and maintain.

3. Eligibility and Account Responsibilities

  • You must be at least 13 years old and legally able to enter these Terms.
  • You must provide accurate account information and keep your email address current.
  • You are responsible for maintaining a strong password and keeping your login credentials confidential.
  • You are responsible for activity under your account unless the activity results from our failure to meet our own security obligations.
  • You must notify CalBudget support promptly if you believe your account has been compromised.

4. Your Data and Permission to Operate the Service

You keep ownership of the budget data, transaction data, imported file data, notes, support messages, feedback, and other content you submit to CalBudget. You grant CalBudget a limited permission to host, store, copy, process, transmit, display, format, analyze, and use that data as needed to provide, secure, support, bill, improve, and maintain the service.

You represent that you have the right to provide the data you enter or import. Do not upload or enter information that you are not allowed to use, disclose, or process through CalBudget.

You are responsible for reviewing imported files before import. CalBudget may parse, normalize, reject, truncate, or transform imported data to fit product requirements, including maximum row limits and field validation. Import tools may create accounts, categories, and transactions based on the imported content.

5. Trials, Subscriptions, Billing, and Taxes

CalBudget may offer free trials, monthly plans, annual plans, promotional access, feedback rewards, or other subscription options. Plan availability, price, billing interval, trial length, and included features may change over time, subject to applicable law and any notice required by the platform that processes your purchase.

Website subscriptions are processed by Stripe. App Store subscriptions are processed by Apple and may be synced through RevenueCat. The platform that processes your purchase may collect payment information, apply taxes, handle currency conversion, enforce payment rules, and provide subscription management tools under its own terms.

Unless stated otherwise at checkout, paid subscriptions renew automatically until canceled. You authorize the applicable payment provider to charge the subscription fees, taxes, and any other permitted charges for the plan you select.

6. Cancellation, Refunds, and Account Deletion

You may cancel a website subscription through the CalBudget account settings or Stripe billing portal where available. Cancellation generally takes effect at the end of the current paid period unless the checkout, billing portal, or applicable law says otherwise.

If you purchased through Apple, you must manage cancellation, refunds, and renewal through Apple's subscription settings or Apple support. CalBudget cannot always cancel, refund, or modify App Store payments directly.

Fees are non-refundable except where required by law, where the payment platform grants a refund, or where CalBudget chooses to provide a credit or refund at its discretion. Deleting your account is not the same as canceling every subscription unless the deletion flow or support process confirms that billing has been canceled.

7. Optional AI Recommendations

CalBudget may provide optional AI-generated budgeting reviews or forecasts. These features depend on the data you choose to maintain in CalBudget and may be incomplete, inaccurate, outdated, or unsuitable for your circumstances. You are responsible for reviewing AI outputs before relying on them.

AI recommendations are informational only. They do not create a professional relationship, fiduciary duty, advisory relationship, or obligation to monitor your finances. CalBudget may limit how often reports can be generated, change the model or provider, restrict access, or discontinue the feature.

8. No Financial, Legal, Tax, Credit, or Investment Advice

CalBudget is a software tool for organizing and forecasting information you provide. It does not provide legal, tax, credit, accounting, investment, lending, banking, insurance, retirement, or professional financial advice. CalBudget does not recommend securities, guarantee savings, guarantee debt payoff results, guarantee improved credit, or determine whether a purchase, loan, investment, repayment strategy, or budget choice is right for you.

You should consult qualified professionals before making important legal, tax, investment, credit, debt, insurance, or financial decisions.

9. Acceptable Use

You agree not to misuse CalBudget. Prohibited activity includes:

  • Accessing, attempting to access, or helping anyone access another user's account or data without permission.
  • Using CalBudget for unlawful, fraudulent, deceptive, abusive, harassing, or harmful activity.
  • Uploading malicious code, interfering with service operation, bypassing security controls, or probing for vulnerabilities without written permission.
  • Scraping, crawling, bulk exporting, benchmarking, load testing, or reverse engineering the service except as allowed by law or written permission.
  • Submitting false billing information, abusing trials or promotions, evading payment, disputing valid charges in bad faith, or manipulating subscription access.
  • Using CalBudget to store highly sensitive information that the product is not designed for, such as Social Security numbers, full payment card numbers, bank passwords, government IDs, health records, or other regulated records unless we expressly support that use.

10. Third-Party Services and Links

CalBudget works with third-party providers for payments, subscriptions, email, support routing, AI recommendations, weather lookup, hosting, database operations, and other infrastructure. Third-party services may have their own terms, privacy policies, availability limits, security practices, and support processes.

CalBudget may link to third-party websites, products, or resources. We are not responsible for third-party content, policies, accuracy, billing, availability, or security.

11. CalBudget Intellectual Property

CalBudget and its software, design, branding, interface, text, graphics, workflows, code, features, and documentation are owned by CalBudget or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership of CalBudget intellectual property to you.

You may use CalBudget only as allowed by these Terms and the product interface. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from CalBudget except where expressly allowed by law or written permission.

12. Changes, Beta Features, and Availability

CalBudget may change, add, suspend, or remove features, plans, pricing, integrations, limits, or availability at any time. Some features may be labeled or treated as beta, experimental, early access, or preview functionality. Beta features may change quickly, break, produce incorrect output, or be discontinued.

We work to keep CalBudget available, but we do not guarantee uninterrupted operation, permanent storage, perfect accuracy, or compatibility with every device, browser, file format, payment method, or third-party provider.

13. Disclaimers

To the fullest extent allowed by law, CalBudget is provided as is and as available. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and error-free operation.

Forecasts, charts, balances, low-balance warnings, debt plans, AI reports, imported transaction results, and subscription reminders are estimates or organizational tools. They may be wrong if data is missing, stale, duplicated, categorized incorrectly, imported incorrectly, delayed, or affected by real-world activity that CalBudget cannot observe.

14. Limitation of Liability

To the fullest extent allowed by law, CalBudget and its owners, operators, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost savings; lost data; business interruption; subscription disputes; financial decisions; or damages arising from use of or inability to use the service.

To the fullest extent allowed by law, CalBudget's total liability for all claims relating to the service will not exceed the greater of the amount you paid to CalBudget for the service during the three months before the claim arose or one hundred U.S. dollars.

15. Indemnity

You agree to defend, indemnify, and hold harmless CalBudget and its owners, operators, employees, contractors, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of CalBudget, your data, your violation of these Terms, your violation of law, your violation of another person's rights, or your misuse of the service.

16. Suspension and Termination

You may stop using CalBudget at any time. CalBudget may suspend or terminate access if you violate these Terms, fail to pay required fees, create risk or legal exposure, abuse support or billing systems, attempt unauthorized access, or use the service in a way that may harm CalBudget, other users, or third parties.

After termination, provisions that by their nature should survive will survive, including ownership, disclaimers, limitations of liability, indemnity, payment obligations, dispute provisions, and terms related to data retention or deletion.

17. Governing Law, Disputes, and Notices

These Terms are governed by the laws of the United States and the laws of the state where CalBudget is organized, without regard to conflict-of-law principles, except where consumer protection law requires a different rule. Before filing a formal claim, you agree to contact CalBudget support and give us a reasonable chance to resolve the issue informally.

Notices to CalBudget should be sent through CalBudget support. We may provide notices to you through the app, email, account messages, website postings, or other reasonable means.

18. Changes to These Terms

We may update these Terms from time to time. The Last updated date shows when the Terms were last revised. If changes are material, we may provide additional notice through the app, by email, or another reasonable method. Your continued use of CalBudget after updated Terms take effect means you accept the updated Terms.
